Are we ready for Supreme Court Justice Sotomayor

Having lived in south Florida since 1981 I had many years working with and living with a large Hispanic population. For the most part they came from Cuba to escape the horror of Castro. The fact is that most were very conservative, almost all voted for Ronald Reagan. The Hispanic people that I worked with became very good friends, I have been the their home and they have been to mine. I worked with them when they studying for their citizenship exams, I helped them with their efforts to learn English and they helped me with Spanish. Raphael, a very good friend of mine calls me Poppa, as his grandfather. The republican party has lost that voting block by English Only vote in Florida and the sometimes hateful redirect about illegal immigrants. That is unfortunate because especially with the Cuban immigrants are still very conservative but now vote for democrats.

So, how can we fight the lifetime appointment of a judge that is obviously a racist, we will be painted as a racist just for objecting to the Judge’s radical views. The appointment was deliberate by President Obama to secure the Hispanic vote for many years to come. He welcomes the fight over her confirmation and the leftist press is ready to jump on every complaint by the republican minority.

But amidst the hoopla, now is a good time to remember another lawyer who, had he been held merely to the same standards of Sotomayor, may well have been the first Hispanic justice: Miguel Estrada. The self-proclaimed "Party of the people," has shown its true colors. for the Democrats, the nomination of Miguel Estrada proves that it's not enough to be a minority. It's not enough to overcome adversity and triumph through education and hard work. For the Democrats, you must be the "right kind" of minority to garner their support.

The left says she was appointed to the bench by George H.W. Bush which is correct but not because he wanted her as a judge. The fact is that President Bush was forced to appoint Sotomayor as the result of a back-room deal manipulated by NY Senator P. Moynihan. I think Bush has a much regret for appointing her as for his later appointment of Justice Souter, that did not work out to good for the republicans.

Can Judge Sotomayor be beaten without the Republicans looking like democrats did for almost every appointment since Judge Bork. The democrats openly say they are going to “Bork” a republican nominee. The democrats can do as they please an the press will report it as unfavorable to republicans. Justice Thomas is a perfect example to the bias of the press when the democrats are attempting a political lynching of a black man.

Judge Sotomayor has some questionable rulings and writings that must be explained.

In a 2005 panel discussion at Duke University, Sotomayor told students that the federal Court of Appeals is where "policy is made." She said the "Court of Appeals is where policy is made. The fact is making policy is not what a judge is supposed to do, her job is to follow the law as written, not rewrite it to fit her opinion.

Sotomayor told the Berkeley Law School: "Our gender and national origins may and will make a difference in our judging . . .I would hope that a wise Latina woman with the richness of her experience would more often than not reach a better conclusion than a white male who hasn't lived that life." It is no surprise, therefore, she ruled against white Firefighters of New Haven, throwing out the results of a promotion exam because almost no minorities qualified.

Sotomayor has had 5 decisions reviewed by the U.S. Supreme Court, 3 of which have been reversed. One of these was her aggressive pro-environmental anti-energy decision, another was her aggressive pro-litigation anti-business decision, which was overturned unanimously. The New Haven Firefighters is before the court at this time and is expected to be overturned.

She is a bully on the bench, her own former clerk, liberal Jeffrey Rosen, now legal affairs editor for The New Republic, said she has "has an inflated opinion of herself" and is "kind of a bully on the bench." Another clerk who worked on the 2nd Circuit said she's: "not that smart and kind of a bully on the bench . . .She has an inflated opinion of herself, and is domineering during oral arguments, but her questions aren't penetrating and don't get to the heart of the issue."

When ruling to end the 1995 baseball strike, she sided with the player's union against team owners (who sought parity among all teams with an talent-sharing salary cap). Instead Sotomayor created bias in favor of rich teams who can afford to buy up all the good free agents. I understand why Yankees fans might celebrate her promotion to the Supreme Court, but baseball fans from all other cities should complain loudly against her confirmation!

Opposing a U.S. Congressional bill that would forbid activist judges from citing international law (instead of applying American law) in their decisions, Sotomayor wrote the controversial introduction for The International Judge, a book that promotes, in her words, "developing an international rule of law and institution-building."

In her ruling to allow government to ban privately owned weapons belonging to New York citizens, Sonia Sotomayor wrote in Maloney v. Cuomo: "The Second Amendment applies only to limitations the federal government seeks to impose on this right . . . not upon that of the state." In other words any state government can confiscate your weapons.

She has a very, very strict view of church-state separation, and she was aggressive on this idea of a 'living constitution.'" Meanwhile she ruled one Muslim prisoner had a right to receive the Eid ul Fitr feast (a Muslim holiday meal) in his prison cell, and another Muslim prisoner had a right to access a Muslim chaplain, which is fine if she treats other faiths equally, I suspect she would not rule in favor of the ten commandments or nativity seine on the public square.

The democrats have the votes to confirm her and to also cut off debate and force a vote, at the end of the day she will be confirmed, the only thing we have going for us is a complete examination of her record. Remember "Bork" or "Borked" is a verb in the language of our democratic party, all you can do is fight the good fight.

Justice denied by the Obama Administration

Do you folks remember this on election day???????

It is clear that the Black Panther Thugs armed with Night Sticks are at the polling place to intimidate non Obama Voters. They are reported to have said raciest remarks like “You are about to be ruled by a black man Cracker.” Oh, please excuse me, I should not have said “Raciest Remarks.” I forget that if you are black anything is ok, it cannot be raciest.

What they were doing was clearly a violation of election laws, the police were called and took them away.

EXCLUSIVE: Career lawyers overruled on voting case

Justice Department political appointees overruled career lawyers and ended a civil complaint accusing three members of the New Black Panther Party for Self-Defense of wielding a nightstick and intimidating voters at a Philadelphia polling place last Election Day, according to documents and interviews.

Career lawyers pursued the case for months, including obtaining an affidavit from a prominent 1960s civil rights activist who witnessed the confrontation and described it as "the most blatant form of voter intimidation" that he had seen, even during the voting rights crisis in Mississippi a half-century ago.

The career Justice lawyers were on the verge of securing sanctions against the men earlier this month when their superiors ordered them to reverse course, according to interviews and documents. The court had already entered a default judgment against the men on April 20.

Who made the decision to stop this prosecution?????????

Wow, what a relief, North Korea is just bluffing....

North Korea declares end to truce with southern neighbor

North Korea has warned South Korea that its decision to join a US-led anti-proliferation campaign is tantamount to a declaration of war, freeing it from the Korean War armistice.




WASHINGTON (AP) - The White House says North Korea's threats against South Korea will not give it the attention Pyongyang wants and will only add to its isolation.

White House spokesman Robert Gibbs said Wednes

day that North Korea should live up to its promises and stop its provocations against the South.

Pyongyang says Seoul's decision to join an international nuclear anti-proliferation program is tantamount to a declaration of war. The North warned of military strikes and declared their 1953 armistice null and void

Gibbs says North Korea has threatened to end the
armistice many times in past decades but the peace has held.

WHAT THE OLD SARGE THINKS:
Just so you know, I spent one year of my life in South Korea, and I know what the current alert level they are operating under. My best guess is that we have about 10,000 American Soldiers and 20,000 South Korean soldiers carrying a full combat load of live ammunition and they are p
osted on the DMZ looking across about 500 yards of cleared land at and equal number of North Korean soldiers equipped the same way.

I am so releaved there is nothing to worry about, the White House “will not give it the attention.” I am sure they know that all it takes is one of those 60,000 nervous soldiers to pull the trigger on his

fully loaded weapon and we will be in full scale war. I think I would feel better if someone was making an effort to get those soldiers to stand down, oh well, I am just an old soldier and maybe we can just give it no

attention………….

I watched the Commissioning Ceremony, 10 January 2009 on TV, it was an emotional time for me, something about the 43rd President of the United States leading the ceremony naming an Aircraft Carrier for his father, the 41st President of the United States. OK, I admit that I am an old softie, but sometimes it is OK to cry.

Doonesbury' to eulogize military war dead….

2004: Cartoonist Garry B. Trudeau on Memorial Day will devote his comic strip "Doonesbury" to listing U.S. military personnel who have been killed during the war in Iraq. This tradition started in 2004 celebrating the death of our soldiers in the War on Terror. Trudeau did this because he opposed the war in Iraq.

2009: “Doonesbury” discontinued the practice of listing the war dead, maybe he supports the “Overseas Contingency Operation”…….

It’s 3 AM, is anybody home????

The hypothetical 3 a.m. phone call, used by Hillary Clinton in a campaign commercial, strongly suggests a foreign policy crisis in "a dangerous world." Lord knows there could be such a thing.

That call came early on Memorial Day as the North Korean tested a nuclear weapon equal in yield to the bombs dropped on Japan during world war II.

Monday morning's nuclear test appeared to catch the world by surprise, they told Beijing and Washington that they were planning the test some 20-25 minutes before it was carried out.

Later in the day they test fired two short range missals.

Mr. Obama won the White House while promising that his brand of kinder, gentler diplomacy would better rally the world against bad actors. Now would be a good time, and North Korea the right place, to prove it. Oh, wait a minute, we tried that already….

1985: North Korea signs the Nuclear Non-Proliferation Treaty

1989: The Central Intelligence Agency discovers the North Koreans are building a reprocessing facility — a reactor capable of converting fuel rods into weapons-grade plutonium. The fuel rods were extracted 10 years before from that nation's Yongbyon reactor.

President Obama assailed North Korea on Monday for new missile tests, saying the world must "stand up to" Pyongyang and demand that it honor a promise to abandon its nuclear ambitions.

Most of you have seen this nighttime photo of the North and South Korea showing the almost total absence of electrical lighting in North Korea. Not only do the people not have basic services, for the most part they do not have enough food to sustain life.

What they do have is whatever funds that are necessary to demonstrate their military power.

And they always have a well trained, well armed, and well fed army.

And their streets are severely congested.

And our friend, Kim Jong-il has an answer for the UN

Our president said North Korea’s program posed a“grave threat” to world peace.

Will the "Dear Leader" honor his promise to abandon its nuclear ambitions, I do not think so, he will become the source of nuclear arms for Iran, and any terrorist that wants to make his mark on the world, do you think he believes we will launch nuclear weapons in response to an attack on South Korea?

So, what will happen now, the “Axis of Evil” is staring down the President of the United States, how will he answer that 3 AM call?????????

Taps………..




Of all the military bugle calls, none is so easily recognized or more apt to render emotion than Taps. Up to the Civil War, the traditional call at day's end was a tune, borrowed from the French, called Lights Out. In July of 1862, in the aftermath of the bloody Seven Days battles, hard on the loss of 600 men and wounded himself, Union General Daniel Adams Butterfield called the brigade bugler to his tent. He thought "Lights Out" was too formal and he wished to honor his men. Oliver Wilcox Norton, the bugler, tells the story, "...showing me some notes on a staff written in pencil on the back of an envelope, (he) asked me to sound them on my bugle. I did this several times, playing the music as written. He changed it somewhat, lengthening some notes and shortening others, but retaining the melody as he first gave it to me. After getting it to his satisfaction, he directed me to sound that call for Taps thereafter in place of the regulation call. The music was beautiful on that still summer night and was heard far beyond the limits of our Brigade. The next day I was visited by several buglers from neighboring Brigades, asking for copies of the music which I gladly furnished. The call was gradually taken up through the Army of the Potomac."


This more emotive and powerful Taps was soon adopted throughout the military. In 1874 It was officially recognized by the U.S. Army. It became standard at military funeral ceremonies in 1891. There is something singularly beautiful and appropriate in the music of this wonderful call. Its strains are melancholy, yet full of rest and peace. Its echoes linger in the heart long after its tones have ceased to vibrate in the air.


To a soldier there is nothing like the sound of TAPS, where ever you are when the note is sounded you stop what you are doing and face toward the music. If you are in uniform you render a hand salute until the music has stopped, out of uniform you remove you cap and place it over your heart.

The coffin is sometimes transported by way of a horse-drawn caisson. For funerals of former presidents and officers of Colonel rank and above, a riderless horse symbolizing a fallen leader, usually accompanies the caisson. But for many military funerals the casket is simply brought in a hearse. The coffin is usually draped in a U.S flag as a pall.



"Taps" is played on the bugle or trumpet, at a distance (30-50 yards) from the grave site. During this time the “Final Salute” is given.







A shortage of qualified buglers has led to the use of prerecorded versions of the song being used. The group Bugles Across America is attempting to combat this practice.


All that information was to bring you to the real purpose of this post, the last Military Funeral the Old Sarge attended TAPS was provided by a boombox with a cassette tape which just infuriated me. An old soldier had died, who happened to be a friend of mine and there was no bugler present. In recent years the Pentagon decided that a CD digital recording of taps played through a fake bugle would suffice for military funerals.

Suffice, what the hell is suffice, a person who has put his life at risk for this country and a CD in a FAKE BUGLE will suffice, our government has billions to waste and for their veterans they want to just suffice.

Fox News Sunday did a feature on Marine Bugler Tom Day and his efforts to correct the lack of live buglers at military funerals.


Marine Bugler Tom Day, the founder of Bugles Across America. Tom is the only living American to have served in all five branches of the U.S. military, and his work with BAA is legendary.


He took on a personal crusade to in the year 2000 to preserve the tradition of having live, human buglers honor America's veterans at American military funerals. Tom is one of a select group of people with over 60,000 hours of veteran's service. He has played "TAPS" at over 5,000 military funerals in his career.


In the Fox News Sunday segment he stated that it is a pro-bona service and his organization BUGLES ACROSS AMERICA will accept donations. He also said that in a typical year he spends about $10,000 out of pocket to support the service. I do not know about you folks but you can be assured the The Old Sarge will be writing a check.
